Halak, Blues shut out Predators 3-0

GlaxoSmithKline to pay $750m fine in fraud case

Federal prosecutors in ugg boots sale Boston yesterday said British drug giant GlaxoSmithKline PLC agreed to pay $750 million to settle civil and criminal charges that it made and sold adulterated drugs, including the antidepressant Paxil, to Medicaid and other government payers.

It has been responsible for recovering about $6 billion in health care fines and claims in the past decade, about 25 percent of all recoveries nationally.

“A settlement of this size will help build confidence in the public that health care fraud will be prosecuted,’’ said US Attorney Carmen Ortiz, who oversaw the office’s civil and criminal investigations.

The case began when a whistle-blower, Cheryl Eckard, global quality assurance manager for London-based GlaxoSmithKline, filed a complaint in 2004 under the False Claims Act about the company’s manufacturing processes at a Puerto Rican subsidiary. Eckard, who does not live in Massachusetts, filed the complaint under seal in a Boston court because of the expertise of the US attorney’s office, which decided to intervene in the case, according to her lawyer and Ortiz.

Under the settlement unveiled yesterday, GlaxoSmithKline admitted to operating its SB Phamco Puerto Rico Inc. unit “in a manner that was inconsistent with current good manufacturing practice UGG Classic Tall Metallic Boots 5812 requirements,’’ P.D. Villarreal, senior vice president and head of global litigation, said in a statement issued by the company.

GlaxoSmithKline, which gained a foothold in the Boston area when it purchased Sirtris Pharmaceuticals two years ago, said it would take a charge of $750 million against its second-quarter earnings to account for the settlement. Its shares edged down 14 cents, or 0.3 percent, to $40.17 yesterday on the New York Stock Exchange.

The settlement covered four drugs manufactured at a Cidra, Puerto Rico, plant that has since been shuttered: Kytril, an antinausea medication; Bactroban, a topical anti-infection skin ointment; Paxil CR, a controlled release formulation of the company’s antidepressant drug Paxil; and Avandamet, a combination Type II diabetes drug.

According to criminal information filed in the case, prosecutors alleged that the manufacturing plant failed to ensure its Kytril and Bactroban products were free of micro-organism contamination. They also alleged the plant’s processes caused the two-layer Paxil CR tablets to split and that Avandamet tablets didn’t always have the mix of active ingredients UGG Classic Short Metallic Boots approved by the Food and Drug Administration.

Under the civil settlement, GlaxoSmithKline agreed to pay $600 million to the federal government and to states based on a percentage of the Medicaid claims they filed for the four drugs, including more than $8 million that will go to Massachusetts’ Medicaid program. ‘Paranormal Activity 2′ scares up record $41.5 million

According to Paramount, 61 percent of the audience was less than 25 years old, and the exit pollster Cinemascore had moviegoers giving the film an OK but not super grade of “B.” Those two elements combined, plus the arrival of “Saw 3D,” suggest “Paranormal 2″ will probably suffer a significant drop next weekend. But considering the film’s $3 million budget, we doubt Paramount will be complaining. If anything, “Paranormal Activity 3″ will be here before you know it.

The weekend’s other new wide release, Clint Eastwood’s supernatural drama “Hereafter,” expanded from six theaters into 2,181 locations, and earned a decent $12 million. Warner Bros. revealed UGG Classic Tall Bomber Jacket-5804 that 80 percent of the film’s audience was at least 30 years old. That kind of age split often indicates that a movie may have some stamina at the box office, since older audiences commonly avoid a film’s opening weekend. And in fifth place was the best-reviewed film of the year so far, Sony’s “The Social Network,” which dipped 29 percent for a $7.3 million weekend. The David Fincher drama has grossed $72.9 million, but it’s looking like the Oscar hopeful may ultimately fall a tad short of the $100 million finish line. Then again, you never know with Mark Zuckerberg.

Early voting offers encouragement to Democrats

In an ugg boots sale election year when good news has been scarce for Democrats, anxious party strategists are heartened by at least one development: In states that have started voting, early indications are that Democratic turnout could be stronger than expected.

Despite the much-discussed “enthusiasm gap,” early balloting suggests that the voter turnout engine that Barack Obama revved up in 2008 has not sputtered out entirely, according to the Atlas Project, a Democratic consulting firm that analyzed voter data.

The firm told its clients Friday that early ballots in the 17 states where voting has been sufficient to draw historical comparisons show a partisan balance that looks very much like that in 2006, the year Democrats took back the House and the Senate.

“In many states, it even appears that the electorate so far is a little more Democratic than in 2006, although it is still early in the early voting process,” reported the firm, which was founded by Mary Beth Cahill, manager of John F. Kerry’s 2004 presidential campaign, and Steve Rosenthal, a former political director for the AFL-CIO. “Further, in some states like Georgia, Florida, Michigan and North Carolina, African Americans in particular seem to be making up a greater proportion of early voters at this point than in 2006.”

Outside analysts are seeing much the same. “Democrats are not voting at as high rates as they did in 2008, but they are voting at higher rates [than Republicans] in early voting,” said Michael McDonald, a George Mason University associate professor who specializes in voter behavior.

All 50 states have sent out UGG Coquette Slipper absentee ballots. And in 29 of them, in-person early voting is also underway.

While it is impossible to tell for whom early voters are casting their ballots, most states disclose who has voted. Both parties carefully monitor this information so they know where to target their efforts. The Atlas Project analyzed the early voters’ party affiliations, demographic profiles and other factors to assess each party’s turnout efforts.

Republicans - who are expected to make big gains in Congress - say they are neither surprised nor alarmed at what they are seeing. Democrats have surpassed them in recent cycles at turning out early voters, and Obama is holding a series of rallies across the country aimed at re-energizing those who cast their ballots for him two years ago.

“They’ve probably gotten their partisans to the polls. I would take small solace in that if I were them,” said Joe Gaylord, who was Newt Gingrich’s chief political strategist when Gingrich (Ga.) engineered the Republican takeover of the House in 1994.

The tallies don’t show how independent voters are leaning or how much crossover voting is going on.

“In 1994, there was a flip to the Republicans. In 2006, there was a flip to the Democrats,” said pollster David Winston, who advises House Republicans. “Both of these flips were driven by independents, and that’s likely to be the case here, if it occurs.”

How well the two parties are doing at turning out early voters varies from state to state.

In California, the Atlas Project’s analysis suggests that Democrats account for 42.9 percent of the more than 1 million ballots cast thus far, which means they are running slightly UGG Elsey wedge Boots ahead of the 41.4 percent they got in 2006. By comparison, Republicans have cast an estimated 39.7 percent of the early California ballots, which is down slightly from the 40.9 percent they got four years ago.

However, Republicans in California note that Democratic registration overall has grown dramatically in the state. Democrats now have a 13-point edge, which is five points more than it was four years ago.

And Mark DiCamillo, director the nonpartisan California Field Poll, noted that the state’s early voters are heavily concentrated in the liberal San Francisco Bay area. He said nearly three-quarters of the voters in Santa Clara County have requested mail-in ballots, compared with 21 percent in Los Angeles County.

In Nevada, where Senate Majority Leader Harry M. Reid is fighting to hold on to his seat, Democrats appear to have slightly strengthened their early-voting edge from four years ago. The same is true in Michigan, where the proportion of early voters who are African American has increased from 8.2 percent in 2006 to 11 percent so far in 2010, according to Atlas Project figures.

In some states, including Florida and Iowa, Democrats continue to vote early in greater numbers than Republicans, but that advantage is slightly less than it was in 2006.

The firm reported that one state where Republicans appear to be doing well is Arizona, the scene of a monumental battle over illegal immigration. The Democratic share of early ballots in UGG Roxy Boots that state has dropped by 6.5 percent, and the Republican share has grown by 2.3 percent.

New Apple MacBook Air costs less, plus App Store is coming

CUPERTINO, Calif. — Apple (AAPL), basking in uggs sale the success of the iPhone and iPad, is bringing the look of those mobile devices to its computers.
Apple CEO Steve Jobs introduced a MacBook Air notebook, which — like its popular iPad — has no hard drive. It relies instead on flash memory, which is pricey but more durable if dropped or bumped. It also has a much longer battery life.

The computers are available immediately and cost $999 to $1,599, depending upon the size of the screen and the amount of storage. The first MacBook Air sold for more than $2,000.

“I think it’s a smart move,” says Van Baker, an analyst at Gartner. He thinks consumers may opt for the new MacBook Air instead of an iPad or entry-level MacBook laptop, which will hurt some of the other lines, but the overall effect will be greater sales. “Apple’s being very aggressive.”

Additionally, Apple said it will add the popular App Store, now available on the iPhone, iPod Touch and iPad, to Macintosh computers.

“We’ve been inspired by the work we’ve done on the iPad, and we want to bring it back to the Mac,” Jobs said.

As with the iPad and iPhone, Jobs said he will split revenue with outside software developers, keeping 30% of the fees. Apple will begin accepting submissions from developers in November.

The App Store will be added to Macs, as a download, within 90 days. It will also be featured as part of Apple’s upcoming operating system update, Lion, which is expected in summer 2011.

Apple also added its FaceTime video chat service, available now for the iPhone and iPod Touch, to Macs. It’s out today as a beta download at apple.com.

And it introduced a new version of its iLife software suite, with new versions of the iPhoto, iMovie and Garage Band programs.

The new iPhoto has added UGG Roxy Boots templates for slide shows, while iMovie has 15 different ways to turn your video clips into movie trailers accompanied by music from the London Symphony Orchestra. The iMovie video-editing program also added sophisticated audio-editing tools not seen before in iMovie.

‘A higher level of discipline is needed’ to prevent hard hits

Now, their teams could be the ones taking a punishment.

Ray Anderson, the NFL’s executive vice president of football operations, said the league is seriously considering suspending players for dangerous hits, starting as early as this week.

“(Sunday) was particularly disturbing, just the number and violence of the hits,” said Anderson in a phone interview. “No question about it, internally, it’s our state of mind to protect players.”

Harrison, a three-time Pro Bowler, knocked Cleveland Browns receivers Joshua Cribbs and Mohamed Massaquoi out of their game on Sunday in separate hits.

“I hope the NFL does the max, whatever the max is, I hope they give it to him,” Browns tight end Ben Watson told the AP on Monday.

In an email to the Pittsburgh Post-Gazette on Monday, NFL spokesman Greg Aiello said the hit on Cribbs was legal but the one on Massaquoi would be reviewed. Anderson did not address specific cases from Sunday, but acknowledged that Robinson’s hit on Philadelphia Eagles receiver DeSean Jackson is among those under review.

Robinson, who signed a six-year, $57 million contract with the Falcons in the offseason, leveled Jackson after a catch in the second quarter. The hit was so severe, neither player returned to the game.

Meriweather laid out Baltimore Ravens tight end Todd Heap with a helmet-to-helmet hit. Heap laid on the turf for a few minutes but eventually returned despite a sore neck.

Ravens coach John Harbaugh supports suspensions for illegal hits and spoke to the NFL about Meriweather’s infraction on Monday morning.

“A higher level of discipline is needed. If we look at plays that were previously fined, going forward that play can get you fined and suspended,” said Anderson.

Microsoft remains immensely profitable thanks to its aging software monopoly, and it will remain so even if it never figures out the smart-phone market. Yet the stakes go beyond numbers - it’s about staying at the center of computing while information moves away from PCs and into the cloud.

People get e-mail, music, and “Mad Men” on smart phones and other mobile devices - essentially pocket computers - and that information is warehoused at and delivered from far-off data centers, not PC hard drives.

“If Microsoft gets this right, the stock is really, really cheap,” said Michael Holland, founder of investment firm Holland & Co. “It would be an indication they’ve been able to evolve into a 21st century company.”

By almost any measure, Microsoft is nearly out of the mobile game. Its market share fell to 5 percent from 22 percent in 2004, says Gartner. Satisfaction among owners of Windows smart phones is at 24 percent, according to ChangeWave Research; it’s 74 percent for iPhones and 65 percent for handsets powered by Google’s Android. There are a few hundred apps for Windows mobile, 250,000 for Apple and 70,000 for Android.

Release Nobel Prize winner Liu: Chinese activists

Liu’s wife Xia visited her husband in prison on Oct. 10 and told him of his win. She was subsequently placed under house arrest in her Beijing apartment.

Google is testing cars that drive themselves

We’re not just talking about cars running Google Android. This is the stuff of science fiction. The only accident that has occurred so far: One of the cars was rear-ended by a driver at a stop light. Human error!

The vehicles have been tested on 140,000 miles of California road, from Silicon Valley to Santa Monica.

Each car is manned during the tests. One person sits in the driver’s seat, ready to take control of the vehicle instantly by grabbing the wheel or touch the brake should something go wrong with the system. The person in the passenger’s seat is an engineer who monitors the software operations on a computer.

Google (Google) hired engineers who previously participated in competitions and races involving automated cars — important turning points in the development of the technology, which has been coming into its own since around 2005 according to The New York Times.

If your first concern is UGG Classic Crochet Boots one of safety, Google would argue that you’re going about it all wrong.

Safety is one of the the project’s purposes. Google believes that the technology could nearly half the number of automobile-related deaths because computers are supposedly better at driving than humans in the right circumstances.

There are other hypothetical pluses, too. The vehicles’ instant reaction time and 360-degree awareness would allow them to drive closer together on the highway than humans can, reducing traffic congestion. They could be more careful when operating the gas, reducing fuel consumption.

But the biggest benefit for Google would be the hour or so of daily commute time the car owner would save. Instead of driving, he or she could either be productive or entertained in the vehicle, doing work on a wireless Internet (Internet) connection or watching television.

Google doesn’t say it explicitly, but TechCrunch was quick to note that this time could be spent using Google products and absorbing Google-run advertising.

The most optimistic projections put this technology at least eight years away from market, though. Legal hassles are among the myriad problems; all of the current traffic laws assume that a human driver is present in the vehicle.
